These Terms & Conditions (“Terms”) are an agreement between you and Trellium, LLC(doing business as “Troutracker,” “we,” “us,” or “our”) governing your use of the Troutracker app, this website, and related services (together, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Service. By using it, you represent that you meet this requirement and can enter into these Terms.

2. The Service

Troutracker is a fishing journal, reference, and planning tool. It helps you log outings, keep your fly box and gear, save spots, check conditions, and look up reference information. It is provided for general informational and recreational use.

3. Your account

You are responsible for your account and for keeping your sign-in secure. You agree to provide accurate information and to let us know promptly of any unauthorized use. You are responsible for activity that happens under your account.

4. Subscriptions, fees, and renewals

• Anglers. Individual accounts include a free first year for sign-ups during the introductory period described on our pricing page. After the first year, the subscription renews at the then-current price (currently $19.57 per year) unless you cancel.
• Fly shops. Fly shops use Troutracker under a license, billed as agreed when the shop signs up.
• Renewals and cancellation. Paid subscriptions renew automatically at the end of each term. You can cancel before the next renewal to avoid further charges; cancellation takes effect at the end of the current paid term.
• Taxes and changes. Fees are exclusive of applicable taxes. We may change prices on a going-forward basis and will give reasonable notice of changes that affect you.

5. Fly shop (branded) editions

Fly shops may offer a branded edition of Troutracker to their customers. Shops are responsible for the content they publish (such as reports, spots, and recommendations) and for using the Service in line with these Terms. Branding and shop content do not change the privacy of an angler’s personal journal, which remains private to that angler.

6. Your content

You own the content you create in the Service, such as your journal entries, photos, and saved spots. You grant us a limited license to host, store, process, and display that content solely to operate and provide the Service to you. You are responsible for your content and confirm you have the rights to it.

7. Acceptable use

You agree not to:

• Use the Service unlawfully or to infringe others’ rights.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or other users’ data.
• Reverse engineer, resell, or misuse the Service except as the law allows.

8. Third-party services

The Service relies on third-party providers (for example hosting, voice and AI-assisted features, mapping, and payments). Your use of those features may also be subject to the providers’ terms. We are not responsible for third-party services we do not control. See our Use of AI statement for how AI-assisted features work.

9. Safety and the outdoors — important

Troutracker is a journaling and reference tool, not a safety, navigation, or communications device. Conditions, flows, weather, and water can change quickly and the information in the Service — including any AI-assisted suggestions — may be incomplete or out of date. Always use your own judgment, carry proper safety equipment, and do not rely on the Service as your only safety measure. Fishing regulations, licenses, seasons, and closures change and vary by location — you are responsible for confirming current rules with the relevant state wildlife agency before you fish. You assume the risks of fishing and outdoor activity.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.

11. Limitation of liability

To the fullest extent permitted by law, Trellium, LLC and its owners and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless Trellium, LLC from claims, losses, and expenses arising out of your use of the Service or your violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. The state and federal courts located in Colorado will have jurisdiction over disputes, except where applicable law provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Continued use of the Service after changes means you accept the updated Terms.
